Agreement to Terms

Welcome to Dreamify. By downloading, installing, or using the Dreamify mobile application ("App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Yadnyesh Rana ("we," "us," or "our"), the developer of Dreamify.

Use License

Grant of License

We grant you a personal, non-exclusive, non-transferable, limited license to:

• Download and install the App on your personal device(s)
• Use the App for your personal, non-commercial purposes
• Access and use all features of the App

License Restrictions

You agree NOT to:

• Modify, reverse engineer, or decompile the App
• Remove any copyright or proprietary notices
• Use the App for any commercial purposes
• Share your account credentials with others
• Attempt to gain unauthorized access to our systems
• Use the App in any way that violates applicable laws
• Extract or download sounds for use outside the App
• Create derivative works based on the App

Account Terms

Account Creation

To use certain features of Dreamify, you must:

• Sign in with a valid Google account
• Provide accurate and complete information
• Be at least 13 years of age
• Maintain the security of your account

Account Responsibility

You are responsible for:

• All activities that occur under your account
• Maintaining the confidentiality of your login credentials
• Notifying us immediately of any unauthorized use

Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Your account is inactive for an extended period

Content and Ownership

Our Content

All content in the App, including but not limited to:

• Sound recordings and audio files
• Graphics, images, and visual designs
• Software code and algorithms
• Text, logos, and trademarks

are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of:

• Custom sound mixes you create
• Your personal preferences and settings

By using the App, you grant us a non-exclusive license to store and process your content to provide the App's services.

Sound Licensing

The ambient sounds provided in Dreamify are:

• Licensed from various sources or created in-house
• For personal use within the App only
• Not to be extracted, downloaded, or used outside the App

Free Service

Dreamify is currently provided as a free service:

• No subscription fees
• No in-app purchases
• No advertisements

We reserve the right to introduce paid features or subscriptions in the future with advance notice to users.

Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Acceptable Use

You agree to use Dreamify only for lawful purposes. You must not use the App:

• In any way that violates local, national, or international laws
• To transmit any harmful or malicious code
• To harass, abuse, or harm others
• To impersonate any person or entity
• To interfere with or disrupt the App's functionality
• To collect or harvest data from other users

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

We do not warrant that:

• The App will meet your specific requirements
• The App will be available at all times
• All errors will be corrected
• The App is free from viruses or harmful components

Medical Disclaimer

Dreamify is designed for relaxation and sleep improvement purposes only. It is NOT:

• A medical device
• A treatment for sleep disorders
• A substitute for professional medical advice

If you have a sleep disorder or medical condition, consult a healthcare professional.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Personal injury or property damage
• Any damages arising from your use or inability to use the App

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE APP (WHICH IS CURRENTLY ZERO).

Alarm Reliability

While we strive to provide reliable alarm functionality:

• We cannot guarantee alarms will ring in all circumstances
• Device settings, battery optimization, or system issues may affect alarms
• We are not liable for missed alarms or oversleeping
• You should use Dreamify as a supplementary alarm, not your only alarm

Third-Party Services

The App uses third-party services including:

• Google Firebase (authentication, database, analytics)
• Google Play Services

Your use of these services is subject to their respective terms of service:

Updates and Modifications

App Updates

We may:

• Release updates to improve functionality or fix bugs
• Add, modify, or remove features
• Change the App's appearance or interface

Updates may be automatic or require manual installation.

Terms Updates

We reserve the right to modify these Terms at any time. We will notify you of significant changes by:

• Updating the "Last Updated" date
• Posting the new Terms on our website
• Showing an in-app notification

Continued use of the App after changes constitutes acceptance of the updated Terms.

Termination

By You

You may terminate your use of Dreamify at any time by:

• Uninstalling the App from your device
• Deleting your account in the App settings

By Us

We may terminate or suspend your access immediately, without prior notice, if:

• You breach these Terms
• We are required to do so by law
• We discontinue the App

Effect of Termination

Upon termination:

• Your right to use the App immediately ceases
• Your account data may be deleted
• Provisions that should survive termination will remain in effect

Indemnification

You agree to indemnify and hold harmless Yadnyesh Rana from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of applicable laws

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts in Maharashtra, India.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of Dreamify.
